Op vrijdag 21 juni 2024 vindt de Voorjaarsvergadering plaats van de Nederlandse Vereniging voor Procesrecht, met als onderwerp “Fact-finding in Civil Proceedings”.
Met een beurs van de NVvP loopt in het jaar 2023-2024 het rechtsvergelijkende project Fact-finding in Civil Proceedings, waarin de rol van procespartijen, advocaten en de rechter bij de feitengaring in civiele procedures centraal staat.
Het project bestaat uit drie fases. De eerste fase van het project bestond uit de prepublicatie van vier landenrapporten. Experts uit België, Duitsland, Frankrijk en Nederland hebben gerapporteerd hoe de feitengaring in hun civiele procedure verloopt, en ook hoe procesgedrag dat de feitengaring belemmert in de praktijk wordt gesanctioneerd. De tweede fase bestaat uit de publicatie van de landenrapporten met een vergelijkende analyse op vier deelonderwerpen:
- De inhoud van het inleidende processtuk
- Geldt een vorm van nemo tenetur in het civiele recht?
- De rol van de rechter bij feitengaring
- Is er een waarheidsplicht en wordt die gesanctioneerd?
Om het debat over deze onderwerpen te stimuleren - ook gelet op de komende wijzigingen in het civiele bewijsrecht - ontvangen leden van de NVvP de publicatie in boekvorm. Daarnaast zal de publicatie digitaal open access beschikbaar zijn op ResearchGate.net.
De derde fase is het symposium dat de NVvP op 21 juni 2024 voor haar leden organiseert over de vier deelonderwerpen uit de vergelijkende analyse.
Als inleiders zullen optreden mr. C.J-A. Seinen (rechter bij de rechtbank Den Haag en promovendus Civiel Recht aan de Vrije Universiteit Amsterdam), prof. dr. C. Gomille (hoogleraar Burgerlijk Recht, Europees en Internationaal Privaatrecht en Burgerlijk Procesrecht aan de Universiteit van Saarland), prof. dr. W. Vandenbussche (hoogleraar Burgerlijk Procesrecht aan de Universiteit van Gent), en prof. mr. F. Rouvière (hoogleraar Droit privé et sciences criminelles aan de Université d’Aix-Marseille).
Verder zal prof. mr. dr. G. de Groot (president van de Hoge Raad der Nederlanden) de middag inleiden en zullen prof. mr. Y.E. Schuurmans (hoogleraar staats- en bestuursrecht aan de Universiteit Leiden), mr. E.M. Snijders (advocaat bij RESOR), mr. A.M. van Aerde (advocaat bij Houthoff) en mr. I.M.A. Lintel (advocaat bij Wijn & Stael) optreden als referent.
De Voorjaarsvergadering zal volledig in het Engels worden gehouden. Wie daar prijs op stelt, kan tijdens de bijeenkomst gebruik maken van een headset, waarop de Nederlandse vertaling door een tolk te horen zal zijn.
De Voorjaarsvergadering vindt plaats in Utrecht van 10.00 uur tot 16.00 uur. Inloop vanaf 09.30 uur.

Spring Meeting 2024
On Friday, June 21, 2024, the On Friday, June 21, 2024, the Spring Meeting of the Dutch Procedural Law Association will take place, with the topic "Fact-finding in Civil Proceedings."
With a grant from the NVvP, the project Fact-finding in Civil Proceedings will run from 2023-2024. The project will compare the role of litigants, lawyers, and the judge in the fact-finding process in civil proceedings in Belgium, Germany, France, and the Netherlands.
The first phase of the project consisted of the pre-publication of four country reports. Experts from Belgium, Germany, France and the Netherlands have shown how fact-finding takes place in their civil proceedings, and on how behaviours that hinder fact-finding are sanctioned. The second phase consists of the publication of the country reports with a comparative analysis on four sub-topics:
- The extensiveness of the document starting the proceedings
- Does a form of nemo tenetur apply in civil law?
- The role of the judge in fact-gathering
- Is there a duty to tell the truth; if so: is it upheld?
To stimulate the debate on these topics – also in view of any changes in civil evidence law – NVvP members will receive the publication in book form. In addition, the publication will be available digitally open access on ResearchGate.net.
The third phase is the symposium that the NVvP is organizing for its members on 21 June 2024, on the aforementioned four sub-topics.
The speakers will be Ms. mr. C.J-A. Seinen (Judge at the District Court of The Hague and PhD candidate in Civil Law at the Vrije Universiteit Amsterdam), Prof. Dr. W. Vandenbussche (Professor of Civil Procedure at the University of Ghent), Prof. Mr. F. Rouvière (Professor of Droit privé et sciences criminelles at the Université d'Aix-Marseille), and Prof. Dr. C. Gomille (Professor of Civil Law, European and International Private Law and Civil Procedure at the University of Saarland).
Furthermore, Prof. Dr. G. de Groot (President of the Supreme Court of the Netherlands) will introduce the afternoon and Prof. Y.E. Schuurmans (professor of constitutional and administrative law at Leiden University), Mr. E.M. Snijders (lawyer at RESOR), Mr. A.M. van Aerde (lawyer at Houthoff) and Mr. I.M.A. Lintel (lawyer at Wijn & Stael) acts as referent.
The Spring Meeting will be held entirely in English. Anyone who would like this can use a headset during the meeting, on which the Dutch translation can be heard by an interpreter.
The Spring Meeting will take place in Utrecht from 10 a.m. to 4 p.m. Entry from 9:30 am.
